Decision overturned

The Victorian Civil and Administrative Tribunal has overturned the Environment Protection Authority’s restricted approval of HRL’s proposed dual-gas fired power station to be built in Morwell.

The EPA had approved a 300 megawatt version of the plant last year, down from HRL’s proposed 600MW, however HRL have successfully challenged the decision in VCAT, meaning HRL now have full 600MW approval.

VCAT found HRL’s proposal was in line with best practice, however the finding was delivered with a ‘displace’ or ‘replace’ condition, in which any 600MW plant could not go ahead unless it was replacing existing power generation capacity.
